Agreeing to these terms
These terms cover your use of the Pinnacle Saratoga Concrete Company website and any estimate or work you get from us. By using the site, starting from our home page, or by booking a job with us, you agree to them.
If you don't agree with any part, please don't use the site or book work with us. Your signed estimate or contract for a job sits alongside these terms, and where the two differ, the signed agreement for that job controls.
What we do
We're a concrete contractor in Saratoga, CA. Our crew handles residential and light commercial concrete work: driveways, patios, sidewalks, steps, pool decks, garage floors, retaining walls, footings, foundations, stamped and decorative concrete, and cutting. You can read more about our crew and how we work on our About page.
The descriptions on this site are general. The exact scope of your job, including materials, slab thickness, finish and what we remove or haul away, is whatever your written estimate or contract says.
Estimates and pricing
We give free estimates at your property, with no pressure to book. An estimate is our best figure for the work as we see it that day and for the period stated on it, after which we may need to update it because material and labor costs change.
Some conditions only show up once the old slab is broken out and the subgrade, the soil the new slab sits on, is exposed. Soft or wet soil, buried roots, old fill, or a thicker existing slab than expected can add work, and if that happens we'll stop, show you what we found and agree a change with you in writing before we go on.
Changes you ask for after signing, such as a bigger area, a different finish or added steel, are also priced and agreed in writing before we do them.
Scheduling, weather and cancellation
We give you a planned start date when you book, but concrete depends on the weather. We won't pour in rain or in conditions that would weaken the surface, so we may move a pour date, and we'll tell you as soon as we know.
New concrete needs time to cure, the wait while it gains strength, before you walk or drive on it. We'll tell you how long to stay off your slab, and damage from using it early, or from people, pets, vehicles or sprinklers on it before then, isn't our responsibility.
If you need to cancel or reschedule, call us as early as you can. Once concrete, steel or other materials are ordered or delivered for your job, you may be charged for those costs and for work already done, because ready-mix concrete can't be returned once it's batched.
Payment terms
Your written agreement sets out what you pay and when, including any deposit and any progress payments on larger jobs. Unless it says otherwise, the balance is due when the work is complete.
If a payment is late, we may pause work until it's made, and you're responsible for reasonable costs of collecting an unpaid balance as allowed by law.
Your property and site access
You agree to give our crew safe access to the work area and to tell us about anything we can't see, such as sprinkler lines, drain pipes, septic parts or private wiring under the area we're digging. You're also responsible for knowing where your property lines are.
Whether a job needs a permit depends on the city and the work. Your written agreement says who arranges any permit for your job, and if you're unsure, your city's building office is the place to ask.
Warranty and disclaimers
Any warranty on our work is the one written in your contract, and it covers what that contract says it covers. We stand behind our work and want you satisfied, so if something isn't right, call us first and we'll come look.
Concrete is a natural material, and some things are normal rather than defects. Fine hairline cracks, slight color differences between pours, and small surface variations can happen even when the work is done right, which is why we cut control joints, grooves that give the slab a planned place to crack.
No warranty covers damage from tree roots, ground movement, poor drainage you control, de-icing salts, heavy vehicles beyond what the slab was built for, or changes made by others after we finish.
The information on this website is general and provided as is. It isn't advice for your specific property, and we don't promise it's complete or free of errors.
Limitation of liability
To the extent the law allows, Pinnacle Saratoga Concrete Company isn't liable for indirect, incidental or consequential losses connected to this website or our work, such as lost use of a driveway or patio during the job.
Our total liability for any claim about a job is limited to the amount you paid us for that job. Nothing here limits any right you have that the law doesn't allow to be limited.
Disputes and governing law
If you have a problem with our work, please call us first, because most issues get sorted out on site. If we can't settle it that way, we both agree to try good-faith mediation before going to court.
These terms and any job we do are governed by the laws of the State of California. Any court case goes in the courts of Santa Clara County, California, unless the law requires otherwise.
Changes to these terms
We may update these terms from time to time and will post the new version on this page. Changes apply from the date they're posted and don't change a contract you've already signed with us.
Questions about these terms
If anything here is unclear, call us at (669) 310-0413 or reach us through our Contact page, and we'll answer it in plain terms before you book.
